Terms of Service

Last updated: 13 March 2025

1. Scope and provider

These Terms of Service ("Terms") apply to the use of the website https://quodrynnvex.world (the "Website") and to orders placed through it. The provider and contracting party is:

Quodrynnvex
Fußgängerzone Innenstadt zwischen Marienplatz und Stachus, Neuhauser Str. 11
80331 München
Germany

Email: notifyuse@quodrynnvex.world
Phone: +49 89 5505070

By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website or submit orders. Additional terms may apply to specific services (e.g. promotions); they will be communicated at the relevant point.

2. Products and information

The Website offers the product "Stabilentra" and related information. Product descriptions, images and prices are for information purposes. We strive to keep information accurate but do not warrant that descriptions or other content are error-free or complete. Product packaging and labelling may vary. Food supplements are not intended to diagnose, treat, cure or prevent any disease; they are not a substitute for a varied diet and healthy lifestyle. If you have health concerns, consult a doctor.

3. Contract formation

Presentation of products on the Website constitutes an invitation to treat, not a binding offer. By submitting an order (e.g. via the order form), you make a binding offer to purchase the selected product(s) on the terms stated at the time of order. We will send an order confirmation (e.g. by email). A contract is formed when we accept your order (e.g. by confirmation or by dispatching the goods). We may refuse orders in case of errors in pricing or availability, suspected fraud, or for other legitimate reasons.

4. Prices, shipping and payment

Prices are stated in euros (€) and include statutory VAT where applicable. Shipping costs are indicated during checkout; we may offer free shipping above a certain order value. Payment methods are shown on the Website. You must provide correct and complete payment and delivery details. We reserve the right to use third-party payment and shipping providers. Delivery is to the address you provide; risk passes to you upon handover to the carrier (or to you if collected).

5. Consumer rights (Germany)

If you are a consumer within the meaning of German law (BGB), you have a right of withdrawal in accordance with the applicable provisions (e.g. § 355 BGB). Details of your withdrawal right, including time limits and instructions, are set out in our Return Policy. Your statutory warranty rights (e.g. §§ 434 ff. BGB) remain unaffected. For businesses, different terms may apply; we can provide these on request.

6. Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms. You must not: use the Website in any way that violates applicable law; attempt to gain unauthorised access to our systems or data; transmit malware or harmful code; use automated means (e.g. scraping) without our prior consent; or use the Website in a way that could harm, disable or overburden it or other users. We may suspend or restrict access in case of breach.

7. Intellectual property

Content on the Website (texts, images, logos, design, software) is protected by intellectual property rights and belongs to us or our licensors. You may view and use the Website for personal, non-commercial use. You may not copy, modify, distribute or use our content for commercial purposes without our prior written consent, except where permitted by law (e.g. short quotations).

8. Limitation of liability

We are liable without limitation for: intent and gross negligence; injury to life, body or health; breach of essential contractual obligations (cardinal obligations) where we are at fault; and liability under the German Product Liability Act. For slight negligence we are liable only in case of breach of cardinal obligations, and limited to foreseeable, typical damage. Otherwise our liability is excluded to the extent permitted by law. These limitations apply to our employees and vicarious agents. Nothing in these Terms affects your statutory rights as a consumer.

9. Data protection

Your personal data is processed in accordance with our Privacy Policy and applicable data protection law (including the GDPR). By placing an order or contacting us, you provide data necessary for performance of the contract and we process it as described in the Privacy Policy.

10. Dispute resolution

The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board. For consumers in Germany, the competent courts are determined by your place of residence or our place of business; we may also be sued at your place of residence for contracts concluded with consumers.

11. Governing law

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules in your country of residence remain applicable.

12. Changes and severability

We may amend these Terms from time to time. The current version is published on this page with an updated "Last updated" date. For existing contracts, the version valid at the time of order applies unless we agree otherwise. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. For questions, contact us at the address or email above.
